Terms and Conditions for Pickleball Lessons and Clinics

These Terms and Conditions ("Terms") govern the purchase and participation in pickleball lessons, clinics, camps, and related activities ("Activities") offered through this website or marketplace ("Platform"). By booking or purchasing an Activity, you agree to the following Terms.
1. Platform Role
The Platform provides a marketplace where independent instructors, coaches, and organizations ("Providers") can list and offer pickleball lessons, clinics, camps, and other services.
The Platform facilitates discovery, booking, and payment processing but does not own, operate, or directly conduct the Activities unless explicitly stated.
Each Provider is solely responsible for the instruction, organization, safety, and operation of their Activities.
2. Booking and Payment
All bookings must be completed through the Platform.
Payment is required at the time of booking unless otherwise stated. Payments may include:

Activity fee

Taxes
-
Platform service fees (if applicable)
Payments are processed securely through third-party payment processors.
Once payment is completed, you will receive a booking confirmation.
3. Eligibility
Participants must meet any eligibility requirements specified by the Provider, including:

Skill level

Age restrictions
-
Equipment requirements
-
Health and physical ability to participate
Providers may refuse participation if eligibility requirements are not met.
4. Cancellations by Customer
Cancellation policies may vary by Provider and will be displayed on the Activity listing.
Unless otherwise specified:

Cancellations made 48 hours or more before the scheduled start time may receive a full refund.

Cancellations made less than 48 hours before the Activity may not be eligible for a refund.
Refunds may be issued as:

Original payment method
-
Platform credit
5. Rescheduling
Some Providers may allow rescheduling subject to availability.
Rescheduling requests must typically be made at least 24–48 hours prior to the scheduled Activity.
The Provider reserves the right to approve or decline rescheduling requests.
6. Provider Cancellations
Providers may cancel Activities due to:

Weather
-
Court availability
-
Instructor illness
-
Safety concerns
-
Minimum participant requirements not being met
If a Provider cancels an Activity, participants may be offered:

A rescheduled session
-
A full refund
-
Platform credit
7. Weather Policy
Outdoor Activities may be affected by weather conditions.
Providers will determine whether Activities should be postponed, canceled, or moved to an alternative location.
Participants should check for notifications prior to attending scheduled Activities.
8. Participation and Conduct
Participants agree to:

Follow all instructions from the Provider

Use appropriate sportsmanship

Respect other participants and facilities

Use appropriate equipment
Providers may remove participants from an Activity for disruptive or unsafe behavior. No refund will be issued in such cases.
9. Health and Physical Fitness
Pickleball and related activities involve physical exertion.
By participating, you acknowledge that:

You are physically able to participate

You assume all risks associated with athletic activities

You participate voluntarily
If you have any medical conditions that may affect your ability to participate, you should consult a physician before engaging in the Activity.
10. Assumption of Risk
Participation in sports activities carries inherent risks, including but not limited to:

Physical injury

Falls or collisions
-
Equipment-related injuries
-
Environmental hazards
By participating in any Activity booked through the Platform, you voluntarily assume all risks associated with participation.
11. Liability Waiver
To the fullest extent permitted by law, the Platform, its operators, and Providers shall not be liable for:

Personal injury

Property damage
-
Loss or theft
-
Incidents occurring during participation in Activities
Participants agree that the Platform serves only as a facilitator connecting participants with Providers.
12. Independent Providers
Providers are independent operators and are not employees or agents of the Platform.
The Platform does not supervise or control the Activities conducted by Providers.
13. Photos and Media
Activities may occasionally be photographed or recorded for promotional purposes.
By participating, you grant permission for the use of photographs or recordings that may include your likeness, unless you notify the Provider in advance.
14. Intellectual Property
All content on the Platform, including text, graphics, and logos, is the property of the Platform or its licensors and may not be reproduced without permission.
15. Modifications to Activities
Providers may modify the format, schedule, location, or structure of an Activity when necessary for safety or operational reasons.
16. Limitation of Liability
To the maximum extent permitted by law, the Platform's liability for any claim arising from the use of the Platform or participation in Activities shall be limited to the amount paid for the Activity.
17. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.
